1. What You're Signing Up For

1.1 Products and Services

OAURA provides digital tools designed to support individuals living with Obsessive-Compulsive Disorder (OCD). Our products include educational content, AI-powered therapeutic chat, guided exposure exercises, response prevention journaling, and meditation content based on evidence-based approaches such as Exposure and Response Prevention (ERP), Acceptance and Commitment Therapy (ACT), and Cognitive Behavioral Therapy (CBT).

Our services include access to both free and paid functionality within the OAURA app, personalized therapeutic conversations with AI, gamified exposure exercises, progress tracking, and meditation practices. All services are intended for general wellness, education, and personal support only. OAURA does not provide psychotherapy, medical care, medical advice, or professional mental health services. Our app does not diagnose, treat, cure, or prevent any medical condition. Our app is not a substitute for diagnosis, treatment, or individualized therapy with a qualified healthcare provider.

You understand and agree that the services offered through OAURA are not clinical care and are not supervised by licensed therapists. We recommend that the app be used as a companion alongside, not instead of, professional support.

1.1.1 AI-Powered Features and Non-Human Disclosure

IMPORTANT DISCLOSURE: The OAURA app uses artificial intelligence (AI) technology to provide therapeutic support and guidance. You acknowledge and understand that:

• The AI chat feature is NOT a human being. All responses are generated by computer algorithms, not by licensed therapists, counselors, or human support staff.
• The AI is NOT a mental health professional. It cannot and does not diagnose, treat, cure, or provide clinical mental health services.
• The AI provides educational and therapeutic support only. It is based on evidence-based therapeutic approaches but does not deliver professional therapy or medical treatment.
• The AI operates based on patterns and training data. It does not have consciousness, empathy, clinical judgment, or the ability to understand your unique situation in the way a human professional would.
• AI-generated content may be inaccurate, incomplete, or inappropriate. You should never rely solely on AI output for important mental health decisions or as a substitute for professional care.

By using AI-powered features in OAURA, you confirm that you understand these limitations and that you will not treat AI responses as equivalent to human professional care or medical advice.

1.2 General Rules for Use or Access

By downloading the OAURA app, creating an account, or using our services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

1.3 Changes to Terms

OAURA reserves the right to change or update these Terms at any time. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.

2. Your Account & Subscriptions

2.1 Creating an Account

To use OAURA, you must create a personal account via our OAURA app. When signing up, you'll be asked to provide some basic information, such as your name, email address, and age. You are responsible for maintaining the confidentiality of your login credentials and any actions taken using your account.

Each user may register only one account. You may not share, transfer, or sell your account to anyone else.

By creating an account, you confirm that:

• You are legally allowed to enter into a binding contract under your local laws
• The information you provide is accurate and up-to-date
• You will update your information if it changes
• Your use of the Services does not violate these Terms or any applicable laws

Some features of OAURA may only be available after subscription or completing onboarding.

2.2 Age Requirements

OAURA is intended for individuals who are 18 years of age or older. If we learn that an account has been created by someone under 18, we will terminate the account and remove any related data.

2.3 Subscriptions & Purchases

(a) Free Trials

You may have access to a 7-day free trial of paid features ("Free Trial"). Free Trials automatically convert into a paid monthly or annual subscription at the end of the trial period unless cancelled before the renewal date. You may disable automatic renewal at any time through the platform's subscription settings.

(b) Promotional Free Access

We may offer promotional free access periods (such as free days for new users or rewards for providing feedback). These promotional periods provide temporary access to paid features but DO NOT automatically convert into a paid subscription. After the promotional period ends, you will need to manually subscribe to continue accessing paid features.

(c) Automatically Renewing Subscriptions

Paid features are made available through a recurring subscription ("Subscription"). Subscription terms may be monthly or annual. By activating a Subscription, you authorize the platform to charge all applicable fees and taxes at the beginning of each renewal period.

Unless cancelled, your Subscription will automatically renew at the end of each billing cycle. You may cancel at any time, and your Subscription will remain active until the end of the current term.

(d) Subscription Cancellation

You are responsible for cancelling your Subscription before it renews. We do not provide refunds for partial subscription periods, and cancelling a Subscription does not retroactively affect charges already incurred.

(e) Refunds and Withdrawal Rights

We do not issue refunds directly. All purchases are subject to the payment and refund policies of Apple or Google.

If you reside in the European Union, you may have the right to withdraw from your purchase within fourteen (14) days. This right may be lost once you begin using paid features.

(f) Pricing and Changes

We reserve the right to change pricing for Subscriptions at any time. Any price changes will be communicated to you in advance, and you will have the opportunity to cancel before any such change takes effect.

(g) Additional Limitations

Subscriptions are non-transferable and for personal, non-commercial use only.

(h) Taxes

All prices are shown in your local currency and include applicable taxes where required.

3. Canceling Membership

3.1 Termination by OAURA

OAURA reserves the right to suspend or terminate your access to any part of our app, content, or services if we determine that you've violated these Terms. This action may be taken immediately and without prior notice. If your account is terminated, you may be eligible for a partial refund of any prepaid subscription fees based on the remaining term.

3.2 Cancellation by You

(a) You can cancel your subscription at any time. Monthly subscriptions will remain active until the end of the current billing cycle, and the same applies to annual subscriptions.

(b) If you subscribed through the Apple App Store, you'll need to manage your subscription via your Apple ID settings by navigating to Settings → Apple ID → Subscriptions. For Google Play Store purchases, open the Play Store app and manage subscriptions under Payments & Subscriptions → Subscriptions. Subscription cancellations and renewals handled through Apple or Google are also subject to their respective terms and policies.

4. Prohibited Use of the Products and Services

By using OAURA, you agree that you will not, under any circumstance:

• (a) Copy, store, reproduce, transmit, modify, reverse-engineer, emulate, decompile, or disassemble any part of the Products or Services, or create derivative works from them.
• (b) Use any content, feature, or function of the Services to build or train a competing app, AI, therapeutic tool, or software platform.
• (c) Introduce or upload malicious software, viruses, or harmful code that could interfere with or disrupt the functionality of OAURA or its underlying systems.
• (d) Interfere with or disrupt the servers, infrastructure, or networks connected to the Services, or attempt to bypass any security measures we have in place.
• (e) Access or attempt to access OAURA using unauthorized methods, credentials, or devices, including through automated tools, scraping, or credential fraud.
• (f) Circumvent geographic restrictions or technical limitations that may apply to specific content, features, or jurisdictions.
• (g) Impersonate any individual or entity, or otherwise engage in fraudulent or misleading activity while using the Services.
• (h) Harass, threaten, or abuse others through the platform, including the use of hate speech, discriminatory language, or offensive behavior.
• (i) Use OAURA for any unlawful, defamatory, invasive, obscene, exploitative, or otherwise harmful purpose.
• (j) Use the Services for research, evaluation, or benchmarking purposes without prior written consent from OAURA.
• (k) Resell, sublicense, rent, lease, or otherwise redistribute access to the Services to any third party, whether for commercial or non-commercial use.
• (l) Infringe or violate the intellectual property, privacy, or other rights of any third party while using the Services.
• (m) Attempt to do any of the above, or assist or enable others in doing so.
• (n) Rely on AI-generated content as a substitute for professional mental health diagnosis, treatment, or crisis intervention, or treat AI responses as equivalent to advice from a licensed therapist, counselor, or healthcare provider.

We reserve the right to immediately suspend or terminate your access to the Services, without notice, if we reasonably believe you are in violation of this section or any other part of these Terms. Violating these rules may also constitute a criminal offense under applicable law. We may report such violations to the appropriate authorities and cooperate fully with law enforcement, including disclosing your identity if legally required. We further reserve the right to alert emergency services if, in our sole judgment, we believe you pose an imminent threat to yourself, to others, or to public safety.

5. Matters of Ownership

5.1 Copyright

(a) All materials provided within the OAURA app and services, including but not limited to AI-generated text, interface designs, written guides, exercises, visual elements, logos, structure, source code, and other intellectual property ("Materials"), are the property of OAURA or its third-party licensors, unless otherwise stated. Access to the Materials is granted under a limited, non-exclusive, non-transferable, and revocable license for your personal, non-commercial use only. You do not acquire any ownership rights by using the Services.

(b) You may not copy, store, reproduce, distribute, modify, translate, adapt, create derivative works of, publicly display, or otherwise exploit any part of the Materials, unless explicitly permitted under these Terms or with prior written consent from OAURA or the relevant rights holder.

(c) You may not download, extract, or repurpose any part of the Services, including AI-generated content or structured exercises, for redistribution, publication, automated scraping, or integration into other apps, services, or datasets without explicit permission.

(d) The OAURA app is not intended for commercial, promotional, or research use unless agreed to in writing. Commercial use, including ads, affiliate links, business analytics, or AI training, is strictly prohibited. Any attempt to circumvent technical restrictions, misappropriate content, or misuse our Materials in violation of these Terms will result in immediate termination of access and may lead to legal action.

(e) Unauthorized use of the Services may violate copyright law, intellectual property legislation, and other applicable international regulations. OAURA and its licensors reserve the right to enforce these rights to the fullest extent of the law, including through civil or criminal proceedings where applicable.

6. Availability of Products and Services

OAURA is designed to provide accessible, AI-powered therapeutic support for working through obsessive-compulsive challenges. However, we do not guarantee uninterrupted access, flawless functionality, or that the Services will meet every individual expectation or need.

If a technical issue arises, please contact us at support@ocdaura.com. We will investigate and, where appropriate, take steps to resolve the issue. In some cases, access to features or the entire platform may be temporarily restricted for maintenance, upgrades, or stability improvements.

You acknowledge that:

• OAURA may occasionally be unavailable due to maintenance, unexpected outages, or infrastructure updates.
• Features, tools, or content may be modified, replaced, or discontinued at any time without prior notice.
• We reserve the right to update the Services automatically, including the underlying AI models, without user approval.

We are not liable for temporary unavailability or loss of access, provided these interruptions are within commercially reasonable bounds. Refunds or credits will only be issued in accordance with Section 3 and as required by applicable law.

OAURA does not provide clinical treatment or medical care. While your use of the Services may involve entering personal or mental health-related information (such as chat logs or journal entries), this data does not constitute a medical record, nor is it reviewed by licensed professionals. However, such information may be considered special category personal data under the GDPR, and will be processed in accordance with your explicit consent and our Privacy Policy.

You remain responsible for maintaining backups of any data you wish to keep. We may not retain your content after you delete your account or if your access is terminated.

7. Third-Party Services & Links

7.1 Third-Party Integrations

OAURA relies on third-party services to deliver certain features of our Products, including but not limited to hosting, database management, authentication, AI functionality, and payment processing. For example, we use services like Supabase, Anthropic Claude API, RevenueCat, and Render.

By using OAURA, you acknowledge that your data may be processed by such third parties as part of the Service. In these cases, their respective terms of service and privacy policies may apply in addition to ours. While we select partners carefully and aim for high standards of compliance, we do not control how these external services operate. Where required by law, we have entered into appropriate data processing agreements with such providers to ensure GDPR compliance.

We reserve the right to replace or update these third-party integrations at any time without prior notice.

7.2 External Links

The Products or Services may contain links to third-party websites or resources. These links are provided for convenience or informational purposes only. OAURA does not endorse or control the content, policies, or practices of any external sites, and we are not responsible for their availability, accuracy, legality, or safety.

Your use of third-party websites or tools is at your own risk. We encourage you to review the privacy and security policies of any external service before interacting with it.

7.3 Linking to OAURA

You may link to the homepage of OAURA (e.g. ocdaura.com) in a way that is fair, legal, and does not damage our reputation or misrepresent your relationship with us. However, you must not create the impression of partnership, approval, or endorsement where none exists.

You may not frame our Services on another website or link to other parts of the app or platform without our explicit written consent. We reserve the right to withdraw linking permission at any time if we believe your site or use of our brand is misleading, harmful, or in violation of these Terms.

8. Assumption of Risk

By using OAURA, you acknowledge and accept that the Products and Services provided are intended for educational, wellness, and self-help purposes only. OAURA is not a medical device, does not provide therapy, medical advice, or medical treatment, and is not a substitute for professional mental health care.

OAURA does not offer diagnosis, treatment, cure, prevention, or personalized clinical advice for any medical condition. The AI features, including guided exercises based on ERP, ACT, and CBT principles, journaling prompts, meditation content, and chat functionality, are designed to help users better understand OCD-related challenges and practice evidence-informed techniques for educational purposes. However, they do not replace licensed therapy, and should not be interpreted as professional or clinical guidance.

If you are experiencing distress, are unsure about your mental health condition, or are seeking treatment, we strongly encourage you to consult with a qualified mental health professional. If you are in crisis or experiencing suicidal thoughts, contact local emergency services or a crisis line immediately. Do not rely on OAURA for urgent or life-saving support.

You agree that your use of the Products and Services is at your own discretion and risk. OAURA and its partners disclaim all liability related to:

• Decisions made based on content or suggestions within the app
• Any outcomes from engaging with the AI chatbot, exercises, or lessons
• Interruptions in access or inaccuracies in content
• Emotional distress triggered by exercises, prompts, or interactions

While some features in the app may guide users through techniques based on evidence-based approaches such as ERP, CBT, or ACT, OAURA is not a healthcare provider, does not deliver therapy or medical treatment, and does not guarantee any health outcomes. You remain responsible for evaluating whether any action suggested within the app is appropriate for your personal situation, and should never delay, ignore, or discontinue professional care based on OAURA content.

If you are under the care of a therapist or physician, we recommend discussing your use of OAURA with them. By continuing to use the app, you acknowledge and agree to these terms.

8.1 Crisis Situations and Emergency Resources

If you are in crisis, experiencing suicidal thoughts, or believe you may harm yourself or others, you must immediately:

• Call 988 (Suicide & Crisis Lifeline) available 24/7 in the United States
• Call 112 (Emergency Services) in the European Union
• Contact your local emergency services
• Go to your nearest emergency room or contact a licensed mental health crisis professional

The OAURA app is NOT designed for crisis intervention. While our AI may detect language associated with crisis or suicidal ideation and provide resources, we cannot guarantee detection of all crisis situations. You should never rely on the app to identify or respond to mental health emergencies.

OAURA cannot and does not provide emergency mental health services, crisis counseling, or suicide prevention support. We are not obligated to monitor for crisis situations, and we do not guarantee that our systems will detect all expressions of suicidal ideation or self-harm intent.

9. Warranties and Disclaimers

The OAURA app, including all features, tools, content, and AI-generated responses, is provided "as is" and "as available." OAURA makes no warranties or guarantees, express, implied, statutory, or otherwise, regarding the reliability, accuracy, availability, or suitability of the Services for any specific purpose.

You acknowledge and agree that your use of the app is entirely at your own risk. We cannot guarantee that the app will function without interruption, delay, error, or defect. You are solely responsible for any decisions you make based on your use of the app and any consequences that may follow.

OAURA does not assume responsibility for any loss of data, disruption of service, technical errors, or damage to your device resulting from your use of the app. Where local law prohibits the exclusion of certain warranties, this section will apply only to the extent permitted, and your statutory rights as a consumer remain unaffected.

10. Electronic Communications Consent

By using the OAURA app, you consent to receiving electronic communications from us, including push notifications, email updates, and in-app messages. These communications may include service updates, security alerts, onboarding tips, content recommendations, or important information related to your account or subscription.

By continuing to use OAURA, you agree that communication with us may primarily take place in electronic form and that such communication meets any legal requirement for written communication under applicable law.

You may modify your communication preferences or withdraw consent by updating your settings in the app or contacting support@ocdaura.com. Please note that opting out of essential service-related communications may limit your access to certain app functionalities.

11. Copyright Complaints and Infringement Claims

OAURA respects the intellectual property rights of others and expects users of our app to do the same. You may not upload, distribute, or otherwise make available any content on or through the app that you do not have the legal right to use.

If you believe that any content available through OAURA infringes your copyright, please notify us at support@ocdaura.com. Include:

• A description of the work you believe has been infringed
• Where it appears in the app
• Your contact information
• A good faith statement that you believe the use is unauthorized
• A declaration that the information you provide is accurate

Upon receiving a valid claim, we will review the request and take appropriate action, which may include content removal or account restriction.

12. International Use

OAURA offers self-guided digital tools for mental wellness and education, such as educational content, AI chat, and exercises based on exposure principles. These tools are intended to complement, not replace, professional mental health care.

Our services are not medical devices and are not intended for the diagnosis, treatment, cure, monitoring, or prevention of mental disorders or any medical condition. We do not provide medical advice or medical treatment. If you require medical treatment or are in crisis, please contact a licensed health professional or emergency services in your country.

Access to OAURA may be restricted in countries or jurisdictions where such tools are regulated as medical services or otherwise prohibited by law. By using the app, you confirm that doing so is legal in your country of residence.

Jurisdictional AI Restrictions: Certain jurisdictions have enacted laws restricting the use of artificial intelligence in mental health and therapeutic contexts. While OAURA is designed to comply with these regulations by offering educational and self-help tools rather than clinical services, we do not guarantee that our Services are permissible in all jurisdictions.

If you are located in a jurisdiction where AI-powered mental health support tools are restricted or prohibited, you are responsible for determining whether your use of OAURA is lawful. OAURA reserves the right to restrict access to users in specific jurisdictions where we determine that providing the Services may violate local law. By using the app, you confirm that your use complies with all applicable local, state, and federal laws.

13. Dispute Resolution

We hope to resolve any concerns you may have without legal action. If you have an issue with the app or our services, please contact us first at support@ocdaura.com and we'll do our best to resolve it informally within 30 days.

If we are unable to reach a resolution, then, unless otherwise required by law, any disputes or claims arising out of or relating to these Terms, our Products, or Services will be governed by the laws of the State of California, United States, and handled exclusively by the competent courts in California.

This clause does not restrict your rights under applicable consumer protection laws, including your right to bring claims before the competent court in your country of residence if required by law.

14. General Terms

14.1 Assignment

OAURA may transfer its rights or obligations under these Terms to another company or individual if this does not materially impact your rights. You may not transfer your rights or obligations to anyone else without our written permission.

14.2 Indemnification

To the extent allowed by law, you agree to indemnify and hold harmless OAURA, its directors, team members, affiliates, and partners from any third-party claims, losses, damages, or legal fees arising from your misuse of the Products or Services, breach of these Terms, or violation of any third-party rights. We may assume control of our legal defense if needed, and you agree to cooperate.

14.3 Limitation of Liability

OAURA is not liable for any indirect, incidental, special, consequential, or punitive damages (such as lost profits, lost data, or reputational harm) arising out of your use or inability to use our Products and Services.

Where liability cannot be excluded, our total aggregate liability is limited to the amount you paid in the 12 months prior to the event, or $100 USD, whichever is less.

Nothing in these Terms limits any rights or remedies you may have under applicable consumer law.

14.4 No Waiver

If we delay or fail to enforce any part of these Terms, that does not mean we waive our right to do so later.

14.5 Force Majeure

OAURA is not responsible for failure to perform or unavailability of Products or Services due to events outside our reasonable control (e.g., natural disasters, power outages, internet failures, or regulatory changes).

14.6 Notices

All notices to OAURA must be sent to: support@ocdaura.com.

We may contact you at the email address linked to your account. Notices will be considered delivered once sent or posted.

14.7 Entire Agreement

These Terms (along with our Privacy Policy and any other referenced documents) make up the entire agreement between you and OAURA regarding our Products and Services. They replace any previous agreements or discussions.

14.8 Third Party Rights

Only you and OAURA have rights under these Terms. No third party has legal standing to enforce any part of this agreement.

14.9 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law rules, and in compliance with applicable consumer protection regulations.

14.10 Severability

If any part of these Terms is held invalid or unenforceable, the rest will remain in effect.
